Terms of Service

Welcome to FamiliQC. These Terms of Service ("Terms") govern your use of the familiqc.com website and related services (the "Platform") operated by FamiliQC ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Acceptance of Terms

By creating an account, browsing, or otherwise using the Platform, you confirm that you are at least 18 years old (or have parental consent) and that you agree to comply with these Terms and all applicable laws and regulations, including those of the Province of Quebec and Canada.

2. Account Registration

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Business Listings

If you register a business on FamiliQC, you represent and warrant that you are authorized to act on behalf of that business. You are responsible for the accuracy of your listing information, including business name, address, hours, description, photos, and pricing. We reserve the right to remove or modify listings that violate these Terms or contain inaccurate information.

FamiliQC does not endorse or guarantee the quality, safety, or legality of any listed business, activity, or service. Parents and families should exercise their own judgment when selecting activities.

4. User Content (Reviews and Ratings)

Users may submit reviews, ratings, photos, and other content ("User Content") to the Platform. By submitting User Content, you grant FamiliQC a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content on the Platform and in promotional materials.

You represent and warrant that your User Content:

  • Is truthful, accurate, and based on genuine personal experience.
  • Does not infringe any third-party intellectual property rights.
  • Does not contain defamatory, obscene, hateful, or discriminatory content.
  • Does not include personal information of third parties without their consent.

5. Prohibited Content and Conduct

You agree not to:

  • Post fake, misleading, or fraudulent reviews or listings.
  • Harass, threaten, or intimidate other users or businesses.
  • Upload malicious software, spam, or automated content.
  • Attempt to access other users' accounts or private data.
  • Use the Platform for any illegal purpose.
  • Scrape, crawl, or otherwise extract data from the Platform without permission.
  • Impersonate another person or entity.
  • Interfere with the proper functioning of the Platform.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

6. Premium Services and Business Subscriptions

FamiliQC offers free and premium tiers for businesses. Premium features may include enhanced listing visibility, analytics, priority placement, and promotional tools. Details of premium plans and pricing are available on our Pricing page.

7. Payments and Billing

If you subscribe to a premium plan, you agree to pay the applicable fees. Payments are processed through our third-party payment processor. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy. All prices are in Canadian dollars (CAD) and are subject to applicable taxes (GST/QST).

8. Intellectual Property

All content, design, graphics, logos, and software on the Platform are the property of FamiliQC or its licensors and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any listing, review, or content on the Platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FamiliQC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to damages for loss of profits, data, or goodwill. Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless FamiliQC and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Platform and close your account.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
